Preparing for the Building Safety Regulator
With the October deadline for Gateway 2 implementation looming, the HSE and the Building Safety Regulators have been engaging with industry to help prepare us for the new way of working. The overarching message was clear – get yourselves organised now and don’t wait for secondary legislation.
Building owners now have a duty to evidence to the regulator:
- How their building will be constructed to meet the regulations
- How they have assessed the competency of their team of designers and contractors
- How they are planning on managing building safety during occupation.
This is all before starting on site which means that design work including Contractor Design Portions (CDP) must be completed earlier than we are used to.
Current procurement routes and contracts will need to reflect this change as well as the project cashflow to fund these increased costs prior to obtaining an approval to start on site.
Procurement decisions will need to be take earlier as the detailed information will be required to satisfy the Regulator.
Main Contractors will have to evidence that they have constructed in accordance with the approved design. This will include demonstrating all the products installed will achieve the required performance standards and have the appropriate supporting test data. The correct installation and workmanship must also be evidenced which will require photographic or digital records of every element (every fire door, every fire damper, every penetration, every cavity barrier etc). The Supply Chain will be instrumental in obtaining this evidence and
Main Contractors will need to have systems in place to collate and organise this information for submission to the Regulator. Once the evidence has been collected, it should be checked.
Failure to check what you collect could mean that you issue the Regulator evidence of exactly how you have not discharged your Duties under the Building Safety Act and run the real risk of self-incrimination!
